IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE ARBITRATION AND CLASS ACTION WAIVER SECTION BELOW. PLEASE READ CAREFULLY.

These Terms of Use govern your access to and use of GO Network, a product of Liaison, Inc. (“GO Network,” “we,” “our,” or “us”), including all associated websites, platforms, and services (collectively, the “Platform”).

By accessing or using the Platform, or by submitting any content, communication, or material through it (“User Content”), you agree to be bound by these Terms. These Terms form a legally binding agreement between you and GO Network. If you do not agree, you must not use the Platform.

If you are a business, dealer, or advertiser using the Platform, additional agreements (including any advertising or service agreements) may apply and will control in the event of a conflict.

Platform Use and Control

• Account Responsibility
  You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

• Changes to Terms and Platform
  We may update, modify, or replace these Terms or our Privacy Policy at any time, in our sole discretion.

  • Changes are effective immediately upon posting unless otherwise stated.

  • We are not required to provide notice of any updates, regardless of materiality.

  • Continued use of the Platform constitutes acceptance of the revised Terms.

  We may also modify, suspend, restrict, or discontinue any part of the Platform at any time, with or without notice, and without liability.

• Right to Refuse or Terminate Access
  We reserve the right, at any time and for any reason, to:

  • refuse service;

  • suspend or terminate accounts;

  • remove content;

  • cancel transactions or interactions;

  This includes, but is not limited to, situations where we believe conduct:

  • violates applicable law or these Terms;

  • poses risk to the Platform, users, or third parties;

  • is abusive, fraudulent, or harmful to GO Network’s interests, operations, or reputation.

• Privacy Reference
  Your use of the Platform is also subject to our Privacy Policy, which governs how we collect, use, and share information.

Communication Consent

By submitting your information, you expressly consent to be contacted by GO Network, as well as its partners, dealers, affiliates, and other relevant third parties, at the phone number and email you provided. This may include phone calls and text messages (SMS/MMS), including those sent using an automatic telephone dialing system or artificial/prerecorded voice, for purposes such as responding to your inquiry, providing product or listing information, financing options, and marketing communications.

You understand that your consent is not a condition of any purchase.

Message frequency may vary. Message and data rates may apply. You may opt out of receiving text messages at any time by replying “STOP,” and may opt out of calls as provided in our Privacy Policy.

By submitting your information to any form you acknowledge that you have read and agree to ATVGO’s Terms of Use and Privacy Policy.

Ownership and Permitted Use

All rights, title, and interest in and to the Platform, including all content, technology, software, design, layout, data, and underlying systems (collectively, “Platform Content”), are owned by GO Network or its licensors, affiliates, or partners and are protected by applicable intellectual property and proprietary rights laws.

Your access to the Platform grants you a limited, revocable, non-exclusive, non-transferable license to use the Platform solely for personal, lawful, and non-commercial purposes in connection with its intended use.

No ownership rights are transferred to you under any circumstances.

For clarity, GO Network does not claim ownership of third-party listings, business information, or publicly available data displayed through the Platform.

Restrictions on Use

Except as expressly permitted, you may not:

• copy, reproduce, modify, distribute, display, publish, or create derivative works from any part of the Platform or Platform Content;

• use any content, data, or materials for commercial purposes without prior written consent;

• remove, alter, or obscure any copyright, trademark, or proprietary notices;

• use GO Network’s name, trademarks, or branding in any way that suggests affiliation, endorsement, or association without authorization;

• frame, mirror, overlay, or otherwise incorporate the Platform or its content into any third-party service or interface;

• attempt to access, extract, or expose underlying source code, algorithms, or system architecture through reverse engineering, decompilation, or similar means.

Automated Access and Data Extraction

Use of automated tools or methods to access the Platform is strictly prohibited without prior written permission.

This includes, but is not limited to:

• scraping, crawling, or data extraction tools;

• bots, scripts, or automated queries;

• data mining, harvesting, or indexing activities;

• any system designed to monitor, copy, or collect Platform data at scale.

Any unauthorized automated access may result in:

• immediate suspension or termination of access;

• blocking of IP addresses or systems;

• legal action where applicable.

A limited exception may be granted to general-purpose search engines solely for the purpose of indexing publicly available pages for search results, provided they comply with standard industry practices, clearly identify themselves, and do not replicate or compete with the Platform’s core functionality. This exception may be revoked at any time.

Intellectual Property Protections

All trademarks, service marks, logos, and branding displayed on the Platform are the property of GO Network or their respective owners.

You agree not to:

• use, copy, or imitate any such marks without authorization;

• take any action that could dilute, damage, or interfere with those rights.

Reservation of Rights

All rights not expressly granted are reserved by GO Network.

You acknowledge that:

• access to the Platform does not grant any ownership or license rights beyond those explicitly stated;

• any unauthorized use of the Platform or its content may result in termination of access and legal enforcement.

Search, Indexing, and Data Aggregation

GO Network operates as a search, indexing, and aggregation platform that collects, organizes, and displays information relating to vehicles, equipment, and related listings from a variety of sources.

• Content displayed on the Platform may be obtained from publicly available information, third-party providers, user submissions, data partners, or other lawful sources.

• Listings and business information may be aggregated, normalized, or derived from multiple sources and may not reflect any single source in its original form.

• GO Network does not claim ownership of third-party content and does not guarantee the accuracy, completeness, or timeliness of any such information.

Implied License and Public Data

To the extent permitted by applicable law, by making information publicly available online or submitting content to the Platform, you grant GO Network a limited, non-exclusive, worldwide, royalty-free license to access, index, store, reproduce, display, and process such information solely for the purpose of operating, improving, and providing a search, indexing, and aggregation service.

This includes the ability to organize, normalize, combine, and present such information with other data sources as part of the Platform’s functionality.

This license does not transfer ownership of any underlying content and applies only to the extent reasonably necessary to provide the Platform.

Industry Practices and Technical Controls

GO Network makes commercially reasonable efforts to operate in a manner consistent with generally accepted industry practices for search engines and indexing services.

• We may recognize and respect standard technical protocols, including robots.txt files and similar automated access controls, where reasonably identifiable and feasible.

• We maintain internal processes intended to reduce indexing of content from sources that clearly indicate restrictions on automated access.

• We do not intentionally circumvent access controls, authentication mechanisms, or technical barriers designed to restrict access to data.

Nothing in this section constitutes a guarantee that all restrictions will be identified, interpreted, or honored in every instance.

No Duty to Monitor or Enforce Third-Party Terms

GO Network is not a party to, and is not responsible for enforcing, the terms of service or contractual restrictions of third-party websites or data sources.

• We do not assume any obligation to monitor, interpret, or enforce third-party terms, policies, or restrictions.

• Any reliance on third-party restrictions or representations is at your own risk.

Free Listings and No Affiliation

• Inclusion of listings on the Platform is generally free and does not require a direct relationship with GO Network.

• Display of any listing does not imply endorsement, affiliation, or partnership with any business or individual.

Opt-Out and Removal

If you do not wish to have your information displayed on the Platform, you may request removal by:

• contacting us directly; or

• claiming your listing or account and removing it through available controls.

We will make commercially reasonable efforts to process such requests; however:

• removal may not be immediate;

• content may persist in backups, caches, or third-party systems;

• certain data may be retained for legal, security, or operational purposes.

Reservation of Rights

GO Network reserves the right, in its sole discretion, to determine:

• what data is collected, indexed, displayed, modified, or removed;

• how content is presented, ranked, or combined;

• whether to limit, restrict, or discontinue indexing of any source.

Additional Protections

• GO Network is not responsible for the original source, accuracy, or legality of third-party content.

• We are not liable for any claims arising from the indexing, display, or aggregation of publicly available or third-party information.

• Users and third parties are responsible for ensuring that any information they make publicly accessible is appropriate for indexing and aggregation.

Use at Your Own Risk

All content, materials, listings, reviews, data, products, and services made available through the Platform are provided for general informational purposes only and are used at your own risk.

• You are solely responsible for verifying the accuracy, completeness, and reliability of any information before relying on it.

• Any decisions you make based on Platform content—including purchasing, contacting sellers, or entering into agreements—are made independently and at your own discretion.

• GO Network does not guarantee the accuracy, quality, legality, safety, or availability of any listings, content, or services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ACKNOWLEDGE AND AGREE THAT:

• YOUR USE OF THE PLATFORM AND ANY INFORMATION OR SERVICES OBTAINED THROUGH IT IS ENTIRELY AT YOUR OWN RISK;

• YOU ARE SOLELY RESPONSIBLE FOR ANY LOSS, DAMAGE, OR HARM RESULTING FROM SUCH USE;

• GO NETWORK SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT CONSEQUENCES ARISING FROM YOUR RELIANCE ON PLATFORM CONTENT OR INTERACTIONS WITH THIRD PARTIES.

Accounts and External Links

If you create an account on the Platform, you are responsible for maintaining the security and confidentiality of your account credentials, including your username, password, or any identifying access information.

• You are solely responsible for all activity that occurs under your account, whether authorized or not.

• You agree to notify GO Network immediately of any unauthorized access, suspected breach, or misuse of your account.

• We are not liable for any loss, damage, or unauthorized activity resulting from your failure to safeguard your account.

• You may be held responsible for losses incurred by GO Network or others due to use of your account.

GO Network may assign account identifiers, login credentials, or listing IDs in connection with your use of the Platform. Access to certain features, including modifying account information or managing listings, may be restricted to authenticated users.

Use of the Platform for transactions, listings, or account-based features requires that you meet all eligibility requirements, including being at least 18 years of age and legally capable of entering into binding agreements. We reserve the right, at any time and in our sole discretion, to:

• refuse service;

• suspend or terminate accounts;

• remove or modify content;

• cancel or restrict any activity associated with an account.

Third-Party Links and Services

The Platform may include links to third-party websites, services, or content that are not owned or controlled by GO Network.

• These links are provided for convenience only and do not constitute endorsement, sponsorship, or affiliation.

• Your access to and use of any third-party site is at your own risk.

• GO Network is not responsible for the content, accuracy, policies, security, or practices of any third-party websites or services.

• Any interactions, transactions, or reliance on third-party content are solely between you and that third party.

Third-party services integrated into the Platform (such as video hosting or similar features) may be subject to their own terms and policies. By using such features, you agree to comply with those third-party terms where applicable.

Data Security and Information Use

GO Network implements administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, or disclosure. While we take reasonable measures to secure data, no system or method of transmission over the internet is fully secure.

• We do not guarantee the absolute security, confidentiality, or integrity of any information.

• Any data transmitted to or through the Platform is provided at your own risk.

• You are responsible for taking appropriate precautions to protect your own systems and information.

Data Collection and Use

All personal information you provide to GO Network through the Platform or any electronic communication is collected, used, and disclosed in accordance with our Privacy Policy.

• The Privacy Policy is incorporated into these Terms by reference and forms part of this agreement.

• By using the Platform or submitting information, you acknowledge and agree to the practices described in the Privacy Policy.

User Content

You may submit, upload, post, or otherwise provide content through the Platform, including reviews, messages, feedback, ideas, data, or other materials (collectively, “User Content”).

By submitting User Content, you grant GO Network and its affiliates, partners, and licensees a worldwide, perpetual, irrevocable, royalty-free, transferable, and non-exclusive license to:

• use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any format or media, now known or later developed;

• combine User Content with other content or materials;

• use any name, username, or identifier associated with your submission, at our discretion.

This license applies without compensation to you and survives termination of your account or use of the Platform.

Dealer Inventory Feeds and Data Authorization

Certain features of the Platform may allow dealers, businesses, advertisers, or other users (“Dealers”) to submit inventory feeds, data feeds, APIs, integrations, URLs, credentials, files, exports, or other inventory-related information (“Dealer Feed Data”) for synchronization, display, processing, advertising, indexing, distribution, or publication through the Platform.

By submitting, connecting, authorizing, or enabling any Dealer Feed Data, you expressly represent, warrant, and agree that:

• you own or control all rights necessary to provide such Dealer Feed Data to GO Network;

• you have full authority to authorize GO Network to access, retrieve, import, store, process, reproduce, modify, display, distribute, advertise, publish, and synchronize such Dealer Feed Data;

• you have obtained all required permissions, approvals, licenses, and authorizations from any third-party provider, dealer management system (“DMS”), inventory management provider, website provider, CRM provider, manufacturer program, or other applicable third party associated with such Dealer Feed Data;

• your submission and authorization of Dealer Feed Data does not violate any agreement, policy, contractual restriction, intellectual property right, confidentiality obligation, or applicable law;

• GO Network is entitled to rely entirely on your authorization and instructions regarding such Dealer Feed Data without independent verification.

You further grant GO Network and its affiliates, partners, service providers, sublicensees, successors, and assigns a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to access, retrieve, host, cache, copy, normalize, process, adapt, synchronize, display, distribute, publish, advertise, create derivative works from, and otherwise use Dealer Feed Data in connection with operating, marketing, improving, promoting, and providing the Platform and related services.

This license survives termination of your account, removal of a feed, expiration of any subscription, or discontinuation of use of the Platform with respect to any content previously processed, cached, indexed, published, or distributed by GO Network.

You acknowledge and agree that:

• GO Network acts solely as a passive technology platform and service provider with respect to Dealer Feed Data;

• GO Network has no obligation to independently verify ownership, authorization, or contractual rights associated with any Dealer Feed Data;

• any dispute regarding authorization, ownership, licensing, contractual restrictions, DMS access, or third-party rights relating to Dealer Feed Data is solely between you and the applicable third party.

You agree to fully defend, indemnify, and hold harmless GO Network and its affiliates, officers, employees, contractors, licensors, partners, and service providers from and against any and all claims, demands, disputes, investigations, liabilities, damages, losses, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Dealer Feed Data;

• your lack of authorization to submit or synchronize Dealer Feed Data;

• alleged violations of any DMS agreement, provider agreement, intellectual property right, confidentiality obligation, or third-party terms;

• claims by any inventory provider, DMS provider, technology vendor, website provider, manufacturer program, or third party relating to GO Network’s ingestion, synchronization, display, advertising, processing, or use of Dealer Feed Data authorized by you.

GO Network reserves the right, but not the obligation, to suspend, reject, disconnect, remove, or disable any Dealer Feed Data or integration at any time, for any reason, without liability.

Communications and Interactive Features

The Platform may include tools that allow users to communicate or share content with others, including messaging systems, forums, reviews, comments, chat features, or other interactive services (collectively, “Communication Services”).

These areas may contain content provided by third parties, including users, businesses, or other contributors.

• GO Network does not control, endorse, or guarantee the accuracy, completeness, or reliability of any content shared through Communication Services.

• Any opinions, advice, or statements expressed are those of the individual author and not GO Network.

• You access and rely on such content at your own risk.

Monitoring and Enforcement

GO Network does not review all communications or content in real time and is under no obligation to do so. However, we reserve the right, at any time and in our sole discretion, to:

• monitor, review, access, or retain communications and User Content;

• investigate activity using available technical methods (including device or network identifiers);

• remove, edit, restrict, or refuse any content;

• suspend or terminate access to Communication Services or the Platform.

These actions may be taken for any reason, including:

• enforcing these Terms;

• complying with legal obligations or government requests;

• protecting the rights, property, safety, or integrity of GO Network, users, or third parties;

• preventing fraud, abuse, or harmful activity.

We may also disclose information where required or permitted by law.

Acceptable Use

By using Communication Services, you agree not to post, transmit, or submit any content that:

• violates any law or infringes the rights of others;

• is false, misleading, fraudulent, or deceptive;

• is abusive, harassing, defamatory, obscene, or otherwise objectionable;

• promotes illegal activity or could give rise to liability;

• contains unauthorized advertising, spam, or solicitation;

• interferes with the normal use or enjoyment of the Platform by others.

You are solely responsible for all content you submit and any consequences arising from it.

Responsibility and Liability

• You represent and warrant that you have all necessary rights to submit any content through the Platform.

• You are solely liable for any damage, loss, or claims resulting from your content, including infringement of intellectual property or other rights.

• GO Network is not responsible for any User Content or communications and assumes no liability for any actions taken based on such content.

Access Restrictions

We reserve the right to restrict or terminate access to the Platform or any Communication Services at any time, for any reason, including where we believe a user:

• violates these Terms;

• poses a risk to the Platform or others;

• interferes with normal platform operation or user experience.

Copyright and Infringement Claims

GO Network respects intellectual property rights and expects users to do the same. We may remove or restrict access to content that we believe infringes the rights of others and may terminate repeat infringers where appropriate.

If you believe that content on the Platform infringes your copyright, you may submit a notification in accordance with the Digital Millennium Copyright Act (DMCA). Your notice must include:

• a physical or electronic signature of a person authorized to act on behalf of the copyright owner;

• identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved);

• identification of the material claimed to be infringing, along with sufficient information for us to locate it on the Platform;

• your contact information, including name, address, telephone number, and email address;

• a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;

• a statement that the information provided is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Incomplete or deficient notices may not be processed.

Violations and Enforcement

GO Network reserves the right to investigate, monitor, and take action in response to any suspected violation of these Terms or misuse of the Platform.

• We may access, preserve, and disclose information associated with your use of the Platform where we determine it is appropriate to:

  • enforce these Terms or other applicable agreements;

  • investigate complaints, disputes, or potential misconduct;

  • identify or take action against individuals or entities causing harm to GO Network, its users, or third parties;

  • comply with applicable laws, regulations, legal processes, or government requests;

  • detect, prevent, or address fraud, abuse, security risks, or technical issues.

• We may share information with law enforcement, regulators, or third parties, including for fraud prevention or risk management purposes, where permitted or required by law.

• Communications and activity on the Platform may be retained and used as evidence in investigations, disputes, or legal proceedings.

Account Actions and Remedies

Without limiting any other rights, GO Network may, at any time and without prior notice:

• suspend, restrict, or terminate your access to the Platform;

• block future access from your account, device, or network;

• remove content or listings associated with your account;

• take any other action we deem necessary to protect the Platform or its users.

Legal Rights

You agree that any violation of these Terms may cause irreparable harm to GO Network for which monetary damages alone would be insufficient.

• We reserve the right to seek injunctive, equitable, or other relief, in addition to any other remedies available at law.

• These rights and remedies are cumulative and may be exercised independently or concurrently.

Additional Protections 

• GO Network is not required to provide notice, explanation, or opportunity to cure before taking enforcement action.

• We may act based on reasonable suspicion and are not obligated to conduct a full investigation before taking action.

• Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.

Disclaimer of Warranties

THE PLATFORM, AND ALL CONTENT, LISTINGS, INFORMATION, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH IT, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK;

• GO NETWORK MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY OF ANY CONTENT, LISTINGS, OR SERVICES;

• WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM DEFECTS, VIRUSES, OR OTHER HARMFUL COMPONENTS;

• WE DO NOT GUARANTEE ANY RESULTS FROM THE USE OF THE PLATFORM OR ANY INTERACTIONS WITH THIRD PARTIES.

The Platform may contain delays, errors, omissions, or inaccuracies, including in listings, pricing, descriptions, or availability. You are solely responsible for verifying all information before relying on it.

No Implied Warranties

GO NETWORK EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY;

• FITNESS FOR A PARTICULAR PURPOSE;

• NON-INFRINGEMENT;

• TITLE OR QUIET ENJOYMENT;

• ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Third-Party Content and Services 

GO NETWORK MAKES NO WARRANTIES REGARDING ANY THIRD-PARTY CONTENT, USERS, SELLERS, PRODUCTS, OR SERVICES ACCESSED THROUGH THE PLATFORM.

ALL SUCH INTERACTIONS ARE AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO NETWORK AND ITS OWNERS, AFFILIATES, LICENSORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE PLATFORM OR ANY CONTENT, LISTINGS, PRODUCTS, SERVICES, OR USER CONTENT MADE AVAILABLE THROUGH IT.

THIS INCLUDES, WITHOUT LIMITATION:

• ERRORS, OMISSIONS, OR INACCURACIES IN ANY CONTENT OR LISTINGS;

• INTERRUPTIONS, DELAYS, OR FAILURES IN PLATFORM AVAILABILITY;

• ACTIONS, OMISSIONS, OR CONDUCT OF THIRD PARTIES, INCLUDING USERS, SELLERS, OR SERVICE PROVIDERS.

Excluded Damages

UNDER NO CIRCUMSTANCES SHALL GO NETWORK BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES;

• LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, OR DATA;

• DAMAGES ARISING FROM TRANSACTIONS OR INTERACTIONS BETWEEN USERS;

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF GO NETWORK FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED THE GREATER OF:

• ONE HUNDRED U.S. DOLLARS ($100); OR

• THE AMOUNT YOU PAID TO GO NETWORK, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Additional Limitations

• These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).

• You agree that any claim must be brought in your individual capacity and not as part of any class or representative action.

• If any portion of this section is found unenforceable, the remaining provisions shall remain in full force to the maximum extent permitted by law.

Release and Indemnification

To the fullest extent permitted by law, you agree to release, defend, indemnify, and hold harmless GO Network and its owners, affiliates, officers, directors, employees, partners, licensors, and service providers from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• your use of or access to the Platform;

• your violation of these Terms or any applicable law or regulation;

• any content, data, or information you submit, post, or transmit, including claims of infringement, misappropriation, or other rights violations;

• any dispute, transaction, or interaction between you and any third party, including other users, sellers, advertisers, or service providers;

• your misuse of the Platform or any activity conducted through your account.

GO Network reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully in the defense of such claim.

Release

You hereby release GO Network and its affiliates from any and all claims, demands, and damages of every kind and nature, known or unknown, arising out of or related to any dispute with another user or third party.

California Waiver

If you are a California resident, you waive California Civil Code Section 1542, which provides:

“A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”

You acknowledge that you have read and understand this waiver and expressly agree to it.

Additional Protections

• Your indemnification obligations survive termination of these Terms and your use of the Platform.

• You may not settle any claim without GO Network’s prior written consent if the settlement imposes any obligation or liability on GO Network.

• GO Network is not responsible for any claims arising from third-party conduct, even if facilitated through the Platform.

Miscellaneous

• Prohibited Use of Data
  You may not use the Platform to collect, harvest, or misuse information about other users, including contact details, listings, or activity, for any purpose not expressly permitted by these Terms.
  Use of the Platform for spam, unsolicited communications, or exploitation of user data is strictly prohibited.
  You may not knowingly collect or solicit information from minors.

• No Relationship
  Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and GO Network.

• Electronic Communications
  You agree that all notices, agreements, and communications provided electronically satisfy any legal requirement that such communications be in writing.

• Acceptable Use
  You agree to use the Platform only for lawful purposes. We may restrict or terminate access for any conduct that interferes with the Platform or other users, or that violates these Terms.

• Severability
  If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

• No Waiver
  Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.

• Entire Agreement
  These Terms, together with the Privacy Policy and any applicable additional agreements, constitute the entire agreement between you and GO Network regarding the Platform and supersede any prior agreements or understandings.

• Additional Terms
  Certain features, services, or transactions may be subject to additional terms, which are incorporated by reference where applicable.

DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal Resolution First

We believe most disputes can be resolved quickly and informally. Before initiating any arbitration proceeding, you agree to first contact GO Network and attempt to resolve the dispute informally for at least thirty (30) days.

Binding Arbitration

If a dispute cannot be resolved informally after thirty (30) days, you agree that any claim, dispute, or controversy arising out of or relating to these Terms, the Platform, your use of the Platform, or any products or services provided by GO Network shall be resolved exclusively through final and binding arbitration, except as otherwise expressly provided herein.

The arbitration shall be administered by JAMS under its then-current Streamlined Arbitration Rules and Procedures, except as modified by these Terms.

The arbitration shall take place exclusively in Travis County, Texas, unless the parties mutually agree otherwise.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement, including any claim that all or any portion of this Arbitration Agreement is void or voidable.

The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Time Limitation on Claims

YOU AGREE TO BEGIN ANY ARBITRATION WITHIN ONE (1) YEAR AFTER THE CLAIM OR DISPUTE AROSE. FAILURE TO INITIATE ARBITRATION WITHIN THAT TIME PERIOD SHALL RESULT IN THE CLAIM BEING PERMANENTLY BARRED.

Class Action Waiver

YOU AND GO NETWORK AGREE THAT ALL CLAIMS MUST BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.

THE ARBITRATOR SHALL NOT HAVE AUTHORITY TO CONSOLIDATE CLAIMS OR CONDUCT ANY FORM OF CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

BY USING THE PLATFORM, YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION AGAINST GO NETWORK.

If any portion of this Class Action Waiver is found unenforceable or unlawful for any reason, then such claim shall proceed exclusively in the state or federal courts located in Travis County, Texas, and the parties irrevocably submit to the exclusive jurisdiction of those courts for that limited purpose.

Arbitration Costs and Fees

Each party shall bear its own attorneys’ fees and costs unless otherwise required by applicable law or awarded by the arbitrator.

Notwithstanding anything to the contrary in the applicable arbitration rules, the total aggregate amount GO Network may be required to pay toward arbitration filing fees, administrative fees, arbitrator compensation, or similar arbitration costs shall not exceed the total amount paid by you to GO Network during the twelve (12) months preceding the event giving rise to the dispute.

You acknowledge and agree that arbitration may involve costs different from litigation and that discovery rights may be more limited than in court proceedings.

Exceptions to Arbitration

Nothing in these Terms shall prevent either party from:

• bringing an individual action in small claims court, where permitted;

• seeking temporary, preliminary, or injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, trade secrets, Platform integrity, or to prevent unlawful access, security attacks, fraudulent activity, circumvention of technical protections, system interference, or abusive automated activity that materially harms the Platform;

• pursuing claims relating to intellectual property infringement, misappropriation, piracy, or unauthorized use in state or federal court.

Governing Law

These Terms and any dispute arising out of or relating to the Platform or these Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

Survival

This Arbitration Agreement and Class Action Waiver shall survive termination of your account, your relationship with GO Network, and your use of the Platform.
